A family's fence dilemma has sparked controversy, leaving many questioning the reasoning behind the decision.
Ian and Bethany Buswell, residents of Hallow, Worcestershire, found themselves in a predicament after installing a fence around their home. The fence, designed to ensure the safety of their autistic son Louis, has become the subject of a heated debate.
The couple's journey began when they received a request from the council to trim down a large hedge on their property for health and safety reasons. Eager to comply, they decided to replace the hedge with a smaller fence, investing £3,000 in the project. However, their plans took an unexpected turn when they received a letter demanding they submit a planning application for the new fence, citing a single complaint.
Malvern Hills District Council rejected their application and subsequent appeals, stating that the fence was 78cm too tall and did not align with the "village-like character" of Hallow. This decision has left the Buswells confused and frustrated, especially considering their efforts to enhance safety for their son and the community.
"We were simply trying to do the right thing," Bethany, a mother of two, explained. "The hedge was obstructing the pavement, and with our son's tendency to climb and bolt towards the busy road, we needed a secure barrier."
The 6-foot fence was carefully designed to prevent easy climbing, ensuring Louis' safety. Bethany, who works as a finance analyst for West Mercia Police, emphasized the importance of the fence's height for their son's well-being.
"Our son has managed to get onto the road twice in the past 18 months," she said. "We designed the fence to make it difficult for him to escape, but now we're being told to tear it down."
The council's recent dismissal of their application on February 9th cited the "character and appeal" of the property as the main issue. They argued that the fence's presence would impact the village's character, despite similar fences existing elsewhere in Hallow.
Ian, who runs a car dealership in the village, expressed his confusion and disappointment. "There are other houses with fences of the same height. We even moved the fence back to accommodate the council's request, but it seems like we're being punished for trying to do the right thing."
A spokesperson for Malvern Hills District Council declined to comment in detail, citing an ongoing planning enforcement investigation.
